€75,000 settlement over faulty fuel pump incident

Two Dublin children, who were sprayed with petrol and fumes at a faulty fuel pump when they were aged four years and 21 months respectively, have been awarded almost €75,000 damages against Tesco Ireland Limited.

Barrister Hugh B Byrne told the Circuit Civil Court that Harvey Ring, now aged 11, and his brother Zachary, now aged eight, were with their mother at the Tesco filling station at Clarehall, Malahide Road, as she attempted to put petrol in the family car.

Boy knocked down at level crossing settles case for €100,000

A schoolboy who was knocked down as he walked across a level crossing at a retail park with his father has settled his High Court case for €100,000.

Dylan Duffy's counsel, Vincent Foley SC, told the High Court the car drove "straight through" the zebra crossing at Carrickmines Retail Park, Co Dublin.

The boy, who was seven years old at the time, was knocked unconscious, Counsel said.

Counsel said while the boy regained consciousness quickly, he remained confused for the next 24 hours, and that Dylan was taken to hospital but he did not suffer any brain injury and remained in hospital for a few days.

Family of ‘severely scalded’ 90-year-old woman awarded €54,000 in damages from nursing home

THE FAMILY OF a 90-year-old woman who, they claim, died as a result of scald injuries she suffered in a Co Dublin nursing home, have been awarded just over €54,000 damages for their own pain and suffering, loss, funeral and travel expenses arising from the tragic death of their mother and granny. Barrister Frank Crean told Circuit Court President, Raymond Groarke today that the deceased, Olive Sheeran, suffered severe scalding of her buttocks, left thigh and calf, heels and ankles when a water bottle burst in her bed. High Court awards factory worker more than €220k for fall while trying to free trapped bin

A factory operative who suffered a severe ankle injury when he fell to the ground as he tried to free a trapped bin has been awarded over €220,000 by the High Court. Tomasz Zdejszy fell from a height of about two metres to the ground landing on his right foot in the accident six years ago. Mr Justice Michael Hanna assessed there was 20% contributory negligence on the part of Mr Zdejszy as he did not exercise sufficient care for his own safety. A teenage girl who was injured at a Giraffe crèche ten years ago has been awarded €27,500 damages in the Circuit Civil Court. Barrister Matthew Jolley told the court today Tuesday that 14 year-old Caoilfhionn O’Donnell was only four when she fell from a climbing frame at the Giraffe Crèche at Cherrywood, Loughlinstown, Co Dublin. Duffy says he regrets being involved in road collisions

Presidential candidate Gavin Duffy has said he regrets being involved in a number of car collisions, particularly one in 1993 when he was 33. By that stage in his life, he said, he was married and should have matured. Mr Duffy was previously involved in a collision in 1978, where a woman was seriously injured. Although he said it did not excuse his actions, he said that as a much younger man working in pirate radio, he probably did not have the respect for the law that he should have had. Commission calls for new judicial guidelines for personal injury claims

New judicial guidelines for personal injury claims have been recommended as "a matter of urgency" by an official report. Compensation for 'whiplash' claims here are running at 4.4 times the level in Britain according to the Personal Injuries Commission. The Commission found that the average soft tissue award is €17,338 compared to just €3,984 in Britain. Commission chairman Justice Nicholas Kearns stated in his second and final report, that while genuine claimants need adequate compensation, the negative impact of high premiums on businesses and consumers had to be recognised. A 48-year-old psychiatric nurse has been sentenced to twelve months in prison for assaulting another nurse with a syringe filled with sedating, anti-psychotic medication. Kofi Kankam - with an address at 15 The Clarin, Athenry, Co Galway -  denied a charge of assaulting Emer Hyland, causing her harm, at the Psychiatric Unit at University Hospital Galway, on 5 February last year. Meath community devastated by death of young scout in car crash

A Co Meath community is devastated after learning of the death of a Junior Certificate student in a road traffic crash in Moldova. Marius Bors, 15, was killed in a car crash while on holiday with his family last weekend. Dunshaughlin Scouts hosted a vigil to remember their lost member last night in the village. It is understood that Marius and his father Sergio, who is from Moldova, were travelling to a function when the car was hit side-on. It is believed his mother Victoria, baby sister and brother were following in a second car and witnessed the crash. Boy, 8, seriously hurt in collision between scooter and car

Gardaí have appealed for witnesses after a boy was seriously injured after a car collision with the child’s scooter in Limerick City yesterday evening. The eight-year-old boy was travelling on a child’s scooter when the collision occurred. He was taken to University Hospital Limerick where he is being treated for serious injuries, according to gardaí.
